General Terms and Conditions

The buyer accepts these general terms and conditions in full upon conclusion of the purchase contract. KeilArts reserves the right to amend these terms and conditions at any time.

The image rights and moral rights remain with the artist even after the sale. The following is therefore prohibited, for example (demonstrative list, not exhaustive)

  • any duplication, for example by printing, reproduction, projection, copying or storage,
  • use as a template for drawings, caricatures or reenacted photos,
  • use for layout and customer presentations,
  • any editing (regardless of the medium) and the use of image details, including montages, photo composings or similar techniques,
  • any type of distribution and publication, in particular via television, cable, telecommunications networks or the Internet without express consent.

In any case, other agreements must be made in writing between the seller (artist) and the buyer.

If a work is no longer available, the buyer will be informed by KeilArts as soon as possible. This will result in the order being canceled.

Right of return

In the case of online purchases, there is a statutory right of return in accordance with the Distance Selling Act (BGBl. No. 33/2014 as amended). Prerequisites for the right of return are:

  • all works / objects must be returned complete and undamaged,
  • certificates, labels and protective films are part of the scope of delivery and must be enclosed,
  • the works must be properly packaged,
  • return shipments must be reported and processed within the statutory period,
  • the customer organizes and pays for the professional return transport.

Once KeilArts has received the works / objects back, the amount will be refunded in the same form as paid. The refund is the only service provided by the seller upon return. An exchange is excluded.

The refund will only be made after receipt and quality inspection of the goods.

Buyer's obligations

The buyer is obliged to check the condition of the work / object immediately upon receipt. Any damage or reservations must be reported to KeilArts by e-mail within 48 hours at the latest (notice of defects).

If goods are delivered with obvious transport damage, the buyer must report this immediately and document the damage with photos. Delayed notification shall have no effect on statutory claims, in particular warranty rights, provided that the obligation to notify defects in good time is complied with.

Liability

The liability of KeilArts for slight negligence is excluded. Liability for auxiliary persons is also completely excluded.

In particular, KeilArts shall not be liable for damage attributable to the following causes:

  • improper, non-contractual or unlawful storage, adjustment or use of the goods,
  • use of incompatible replacement parts or accessories,
  • failure to carry out maintenance or improper modification or repair,
  • failure to use the goods in accordance with the instructions of KeilArts,
  • use of incompatible replacement parts or accessories,
  • failure to carry out maintenance or improper modification or repair repair,
  • force majeure (e.g. damage caused by the elements, moisture, dropping or impact),
  • official orders.

Duties and taxes

Any import taxes and duties shall not be borne by KeilArts and must be paid by the buyer.

Shipping and delivery

KeilArts works with qualified shipping partners, but has no influence on delivery times and assumes no liability for delays in delivery.

Payment terms

If the buyer does not meet his payment obligations, all outstanding amounts become due immediately. KeilArts may suspend further deliveries and demand outstanding amounts.

On expiry of the payment period, the buyer shall be in default without further reminder. KeilArts reserves the right to charge interest on arrears and reminder fees (up to €20 per reminder) as well as collection costs. The buyer agrees to the forwarding of his data to a debt collection agency.

Data protection

KeilArts stores data that is required for customer service. Data required for order processing, payment processing, credit checks or statistical analysis may be passed on to third parties. The customer agrees to the disclosure to cooperation partners who are involved in the processing.

Jurisdiction and applicable law

Austrian law applies exclusively. The UN Convention on Contracts for the International Sale of Goods is excluded. For disputes arising from or in connection with these General Terms and Conditions, the competent court in Austria shall have jurisdiction. The seller reserves the right to sue the buyer at his place of residence.
